GENERAL INFORMATION

1.1. These general terms and conditions (hereinafter referred to as “GTC”) apply to all services of Eco Travel GmbH (hereinafter referred to as “provider”) towards customers who are either consumers in the sense of §1 KSchG (hereinafter “guests”) or entrepreneurs in the sense of §1 UGB are (hereinafter referred to as “customer”). They apply in the version valid at the time the contract is concluded. They apply to all transactions on the website available at www.ecosuites.travel and all social media platforms managed by the provider (hereinafter referred to as the “Internet profile”).

1.2. If you use conflicting, deviating and / or supplementary general terms and conditions, these will not become part of the contract unless expressly agreed in writing by the provider.

1.3. The provider grants the customer limited, personal, non-exclusive and non-transferable or licensable use of the website in accordance with these terms and conditions. All rights to the website remain with the provider.

1.4. The use of elements and content (in part or in full) beyond the usual and necessary use of the website by the customer is not permitted without the prior written consent of the provider. This applies in particular, but not exclusively, to the brands, names and characteristics, content, layout, design and interface of the website.

PERFORMANCE DESCRIPTION

2.1. The provider enables its customers to present their accommodation on the website and enables guests to search for accommodation on the website. The booking is made only through direct contact between guests and customers.

2.2. The provider does not act as an intermediary. Any contract regarding services (accommodation, meals, etc.) is concluded directly between the customer and the guest. Any liability or guarantee of the provider towards the guest in this context is excluded, in particular the provider not being liable for the provision of services on the part of the accommodation.

2.3. The provider guarantees the best possible availability of the website within the framework of appropriate and customary standards, but does not accept any liability or liability for the correctness, completeness, suitability or suitability at any time, uninterrupted, error-free or risk-free availability or the possibility of access or a certain success.

2.4. The provider assumes no liability, guarantee or warranty with regard to the legality, accuracy, correctness and completeness of the materials or content (e.g. texts, images or videos) that are published in connection with the accommodation presented on the website, assumed that these materials or contents have been provided by the hotels concerned.

2.5. The provider is entitled to have the contract or parts of the contract carried out by third parties.

2.6. The provider is not responsible for delays in performance due to force majeure and due to extraordinary and unforeseeable events, which cannot be prevented by the provider even with the utmost care.

2.7. The provider can withdraw from the contract at any time, especially in the event of a change in the basis of the fulfillment of the eco suites sustainability criteria in the accommodation.

2.8. The place of performance is the registered office of the provider.

DATA STORAGE, DATA PROTECTION

3.1. The customer is solely responsible for the content and correctness of the data transmitted by him. The customer also undertakes not to transmit any data which violates the rights of third parties or violates existing laws (e.g. personal rights, naming rights, trademark rights, copyrights, etc.).

3.2. The customer is jointly responsible for securing the transmitted information. The provider cannot be held responsible for the loss of information sent to him because he does not provide a general data backup guarantee.

3.3. The processing of the guest’s personal data is based on the General Data Protection Regulation No. 2016/679 (GDPR) and the applicable national data protection standards, in particular the Data Protection Act.

3.4. Responsible in terms of Art 4 Z 7 GDPR is the provider. The following personal data relating to the person of the guest can be collected in connection with the registration for the newsletter: first and last name / company as well as e-mail address.

3.5. By accessing or using the website, the following (sometimes personal data) can also be transmitted to and processed by the provider: log files such as IP address, date and time of access, information about the operating system used and the Internet browser.
